Overview
This document outlines the Terms and Conditions of Eagle Vision S.R.L. (hereby referred to as “Eagle Vision”). The primary language for communication with Eagle Vision is English; however, we also accommodate communications in Italian. For your convenience, an Italian version of Eagle Vision's Terms and Conditions is available below, at the end of the English version. You can request an official copy of this Terms and Conditions in your own language, and we will provide it to you as soon as possible. Please note that messages or requests in languages other than English or Italian will need to be analyzed and assessed through external parties, which may significantly increase the time required for a response.
Please be aware that, for formal communications between parties, only the Terms and Conditions presented below will be considered authoritative. Translations of these Terms and Conditions will be deemed valid only if provided by Eagle Vision.
The following Terms and Conditions of Service govern the use of the mobile application named Eagle Vision Ski (hereinafter "Application") and the website www.eagle-vision.it (hereinafter "Website"), both developed and managed by Eagle Vision S.R.L. (hereinafter "Eagle Vision").
It is expressly stated that access to, download of, or use of the Application or the Website implies the user's full and unconditional acceptance of these terms. Therefore, it is recommended that this document be carefully read in order to fully understand its content before using the services provided by Eagle Vision.
It is strictly prohibited to copy, modify, in whole or in part, the software applications, namely the Application and the Website, provided by Eagle Vision to the public. All attempts to extract the source code, translate it into other languages, or create derivative works based on them are also prohibited.
All trademark rights, copyright, database rights, and any other intellectual property rights related to the software applications developed by Eagle Vision are and remain the exclusive property of Eagle Vision. Any unauthorized use will be prosecuted in accordance with the law.
Eagle Vision's applications are provided free of charge for basic or trial functionalities. For users who wish to use them more regularly and effectively, Eagle Vision offers several subscription options, including:
Each subscription grants access, for a limited period, to additional features of Eagle Vision's applications or allows continued use of the services provided by Eagle Vision. The duration of access to the aforementioned services or features is clearly specified at the time of purchase and is not subject to dispute by the user.
At the end of the subscription period, Eagle Vision's applications will automatically reset the user's access status, returning it to the condition prior to the purchase.
Users may purchase subscriptions using credit cards, PayPal, or other methods available within the applications. Eagle Vision does not guarantee that all payment methods will be available on every platform, as this may be technically or operationally impossible.
It is also specified that due to varying fees applied by online payment processing services, subscription prices may differ between the Application and the Website. By accepting these terms and conditions, the user acknowledges and agrees to Eagle Vision's pricing policies and commits to making their own evaluations accordingly.
Despite potential price differences, subscriptions with the same designation grant the same rights, access to the same content, and services, regardless of the platform used for purchase. By accepting these terms and conditions, the user expressly waives any dispute or claim regarding the payment of differing amounts for the purchase of the same services, solely due to the choice of platform (Website or Application).
The subscriptions offered by Eagle Vision do not include automatic renewal, unless explicitly stated otherwise. In the case of subscriptions with automatic renewal, the user has the option to manage or deactivate this feature by accessing their account settings.
The user has the right to withdraw from the purchase of a subscription within 14 days from the date of purchase, unless the service has already been partially provided. Access to content reserved for subscribers or the provision of any service by Eagle Vision constitutes the commencement of the subscription's use, regardless of the actual enjoyment or use by the user. From that moment onwards, the purchased subscription will no longer be refundable, even partially.
Refunds for purchases made through Eagle Vision are handled in accordance with the applicable laws and regulations in the relevant jurisdiction. To request a refund, the user must contact customer service at the email address legal@eagle-vision.it.
The refund request must be accompanied by the following documents and information, necessary to verify the identity of the requester:
The processing of the request will be subject to verification of the provided documentation. The user will be notified by Eagle Vision regarding the timing and methods of the refund once their request has been processed.
Eagle Vision is committed to ensuring that its applications are as useful and efficient as possible for users. However, Eagle Vision reserves the right to modify the applications at any time and for any reason, at its sole discretion.
The availability of Eagle Vision's applications to the user depends on their compatibility with the operating systems used by the user at the time of access. However, these applications and their technical requirements may evolve over time, leading to changes in the minimum system requirements needed for their operation. The user acknowledges and agrees that if their devices no longer meet the minimum technical requirements established by Eagle Vision, access to the services offered will no longer be possible.
By accepting these terms, the user also acknowledges that, in the case of purchases made through Eagle Vision’s applications, the inability to access the services due to device incompatibility with updated requirements will result in the loss of the economic value of such purchases, with no right to a refund.
To ensure an optimal user experience, the user agrees to regularly download and install any updates made available by Eagle Vision. These updates aim to improve the quality of the service, but Eagle Vision does not guarantee that they will always be relevant to the user or that they will not impact the user’s experience of using Eagle Vision's services. It is the user’s responsibility, and a practice actively encouraged by Eagle Vision, to notify Eagle Vision of any dissatisfaction related to the updates of the applications. Depending on the volume of requests and ongoing operations, Eagle Vision will make efforts to respond to customer feedback and consider it for future updates.
Furthermore, through updates, Eagle Vision reserves the right to introduce new paid features. If this incurs additional costs for the user, they will be clearly and promptly communicated, ensuring that no charges are applied without explicit user authorization.
Eagle Vision's applications collect and store personal data provided by users solely for the purpose of delivering the requested services. For further details on the processing of personal data and the user's rights regarding data protection, users are encouraged to consult Eagle Vision's Privacy Policy, available on the website www.eagle-vision.it.
Some features of Eagle Vision's applications require an active Internet connection, which can be provided via Wi-Fi or through the mobile network of the user's carrier. Eagle Vision assumes no responsibility for any malfunction of the applications caused by the lack of a connection or depletion of available data traffic.
If the applications are used outside an area covered by Wi-Fi, the user agrees to be responsible for any costs arising from the use of the mobile network, including but not limited to data roaming charges. The use of the applications implies that the user has obtained permission from the holder of the mobile phone contract, if the user is not the contract holder.
The user has the option to terminate their contract with Eagle Vision, entered into upon acceptance of these terms and conditions, at any time. The user simply needs to delete their account and confirm the removal of all their data, thus achieving the desired result. This will terminate any interaction between Eagle Vision, the user, and their data.
However, it is specified that closing the account does not entitle the user to a refund or compensation for any amounts previously spent on services offered by Eagle Vision. Similarly, closing the account does not affect the legality of the processing of the user’s personal data that occurred prior to the decision to close the account and delete the data.
In the event of a violation of these terms and conditions, Eagle Vision reserves the right to suspend or terminate a registered user's account, thereby preventing access to its applications. This right may be exercised by Eagle Vision regardless of whether the user has made purchases on Eagle Vision's applications that are still valid.

By using Eagle Vision's applications, and thus by expressly or implicitly accepting these Terms and Conditions, the user waives any rights or claims against Eagle Vision regarding the above-listed points.
All content available in Eagle Vision's applications, including but not limited to videos, images, texts, and logos, is the exclusive property of Eagle Vision or its licensors and is protected by copyright laws and other applicable intellectual property regulations.
Eagle Vision's services are intended for users aged 14 or older. If a user under the age of 14 accesses the service, prior authorization must be provided by the parent or legal guardian. To do so, they may send a communication to legal@eagle-vision.it, and their request will be handled directly by a representative. If a user identifies the use of Eagle Vision's services by a minor under the age of 14, they are asked to promptly inform Eagle Vision so that necessary measures can be taken.
If Eagle Vision discovers that a minor under the age of 14 has provided personal data, the company will immediately delete such data from its servers. If a parent or legal guardian has reason to believe that their child has provided personal information, they are encouraged to contact Eagle Vision's Customer Service without delay at legal@eagle-vision.it to allow the necessary corrective actions to be taken.
By means of this disclaimer, Eagle Vision is considered exempt from any direct or indirect liability related to damage to the image or confidentiality of users who request its services. This exclusion of liability applies in all cases where such image damages are not attributable to violations of the legal obligations to which Eagle Vision is subject.
In its applications, Eagle Vision is integrated with certain third-party providers to facilitate the analysis and functionality of its services. Specifically, Eagle Vision uses Google Analytics and Firebase Analytics for the anonymized analysis of user activities; RevenueCat for managing in-app purchase payments; YouTube for integrating video content; and the payment systems of Google Play, Apple Store, and Stripe for actual transactions between the user and Eagle Vision.
Additionally, some links within Eagle Vision's applications may redirect to external services and websites. For cases that may impact Eagle Vision users, it is necessary to refer to the terms and conditions established by these external sites, as well as the terms set by the third-party providers integrated with Eagle Vision. Eagle Vision therefore encourages its users to review these documents for a complete understanding of the conditions they may be subject to.
In the event that Eagle Vision decides to terminate the offering of its applications, in whole or in part, the user's right to use them will immediately cease on a proportional basis. The user will not be entitled to a refund for any services of Eagle Vision that have already been partially used prior to any termination of the operation of the applications. Furthermore, the user will not be able to claim any compensation for damages arising from the inability to access Eagle Vision's services.
If deemed necessary by Eagle Vision, in the event of termination of the application services, the user will be required to uninstall the applications from their personal devices.
For further information regarding the terms and conditions of Eagle Vision's services, the user is invited to contact Eagle Vision at the dedicated email address legal@eagle-vision.it. Eagle Vision's legal department is committed to providing a timely and comprehensive response to any request received.
If, after consulting with Eagle Vision's legal department, the user finds the explanations and solutions provided unsatisfactory, or continues to be dissatisfied with the terms and conditions they have agreed to, they have the right to file a complaint with the relevant authorities.
Any legal dispute arising from the interpretation, application, or violation of this privacy notice shall be exclusively subject to the jurisdiction of the Tribunale di Milano (Court of Milan). The applicable law will be solely Italian law, to the exclusion of any reference to international laws or conventions not expressly invoked.
This privacy notice may be subject to periodic updates. Any changes will be published on the official Eagle Vision website and, where deemed necessary, directly communicated to the interested parties.
I presenti Termini e Condizioni di Servizio disciplinano l'utilizzo dell'applicazione per dispositivi mobili denominata Eagle Vision Ski (di seguito "Applicazione") e del sito web www.eagle-vision.it (di seguito "Sito"), entrambi sviluppati e gestiti da Eagle Vision S.R.L. (di seguito "Eagle Vision").
Si informa espressamente che l'accesso, il download, o l'utilizzo dell'Applicazione o del Sito implica l'accettazione integrale e incondizionata dei presenti termini da parte dell'utente. A tal fine, si raccomanda di leggere attentamente il presente documento al fine di comprenderne il contenuto prima di utilizzare i servizi forniti da Eagle Vision.
È rigorosamente vietato copiare, modificare, in tutto o in parte, gli applicativi, ossia Applicazione e Sito, forniti da Eagle Vision al pubblico. Sono altresì proibiti tutti i tentativi di estrazione del codice sorgente, la traduzione in altre lingue, nonché la creazione di opere derivate basate sugli stessi.
Tutti i diritti di marchio, copyright, diritti sui database e ogni altro diritto di proprietà intellettuale relativi agli applicativi sviluppati da Eagle Vision sono e restano di esclusiva proprietà di Eagle Vision. Qualsiasi utilizzo non autorizzato sarà perseguito ai sensi di legge.
Gli applicativi di Eagle Vision sono forniti in maniera gratuita per funzionalità base o di prova. Per gli utenti che desiderano utilizzarli in maniera più assidua ed efficace, Eagle Vision offre diverse opzioni di abbonamento, tra cui:
Ciascun abbonamento consente, per un periodo di tempo limitato, di accedere a funzionalità aggiuntive degli applicativi di Eagle Vision o di continuare a usufruire dei servizi forniti da Eagle Vision. La durata del periodo di accesso ai suddetti servizi o funzionalità è chiaramente specificata al momento dell’acquisto e non è soggetta a contestazioni da parte dell'utente.
Al termine del periodo di validità dell'abbonamento, gli applicativi di Eagle Vision reimposteranno automaticamente lo stato di accesso dell'utente, riportandolo alla condizione precedente all'acquisto.
Gli utenti possono effettuare gli acquisti degli abbonamenti utilizzando carte di credito, PayPal o altri metodi messi a disposizione all'interno degli applicativi. Eagle Vision non garantisce che tutti i metodi di pagamento siano disponibili su ogni piattaforma, in quanto ciò potrebbe essere tecnicamente o operativamente impossibile.
Si specifica, inoltre, che a causa delle diverse commissioni applicate dai servizi di gestione dei pagamenti online, i prezzi degli abbonamenti potrebbero variare tra l'Applicazione e il Sito. L'utente, accettando i presenti Termini e Condizioni, dichiara di comprendere e accettare le politiche di prezzo di Eagle Vision e si impegna ad agire di conseguenza, effettuando le proprie valutazioni in merito.
Nonostante la possibile differenza di prezzo, gli abbonamenti con la stessa denominazione garantiscono pari diritti, accesso ai medesimi contenuti e servizi, indipendentemente dalla piattaforma utilizzata per l'acquisto. Accettando i presenti termini e condizioni, l'utente rinuncia espressamente a qualsiasi contestazione o reclamo relativo al pagamento di importi differenti per l'acquisto degli stessi servizi, motivata esclusivamente dalla scelta della piattaforma (Sito o Applicazione).
Gli abbonamenti offerti da Eagle Vision non includono il rinnovo automatico, salvo esplicita indicazione contraria. In caso di abbonamenti con rinnovo automatico, l'utente ha facoltà di gestire o disattivare tale opzione accedendo alle impostazioni del proprio account.
L'utente ha il diritto di recedere dall'acquisto di un abbonamento entro il termine di 14 giorni dalla data di acquisto, salvo che il servizio non sia stato già parzialmente erogato. L'accesso a un contenuto riservato agli abbonati o l'erogazione, da parte di Eagle Vision, di uno dei suoi servizi costituisce l'inizio dell'utilizzo dell'abbonamento, indipendentemente dall'effettiva fruizione o utilizzo da parte dell'utente. A partire da tale momento, l'abbonamento acquistato non sarà più rimborsabile, nemmeno parzialmente.
I rimborsi relativi agli acquisti effettuati tramite Eagle Vision sono gestiti in conformità alle normative vigenti applicabili nel territorio di riferimento. Per richiedere un rimborso, l'utente è tenuto a contattare il servizio clienti all'indirizzo email legal@eagle-vision.it.
La richiesta di rimborso deve essere accompagnata dai seguenti documenti e informazioni, necessari per verificare l'identità del richiedente:
L'elaborazione della richiesta sarà subordinata alla verifica della documentazione fornita. L’utente sarà notificato da Eagle Vision riguardo le tempistiche e le modalità di rimborso non appena la l’elaborazione della sua richiesta sarà evasa.
Eagle Vision si impegna a garantire che i propri applicativi siano il più utili ed efficienti possibile per gli utenti. Tuttavia, Eagle Vision si riserva il diritto di modificare gli applicativi in qualsiasi momento e per qualsiasi ragione, a propria esclusiva discrezione.
L'eventuale disponibilità degli applicativi di Eagle Vision per l'utente presuppone la loro compatibilità con i sistemi operativi utilizzati dall'utente al momento dell'accesso. Tuttavia, tali applicativi e le loro esigenze tecniche potrebbero evolversi nel tempo, comportando modifiche ai requisiti minimi di sistema necessari per il loro funzionamento. L'utente prende atto e accetta che, qualora i propri dispositivi non soddisfino più i requisiti tecnici minimi stabiliti da Eagle Vision, non sarà più possibile accedere ai servizi offerti.
Accettando i presenti Termini, l'utente riconosce altresì che, in caso di acquisti effettuati su applicativi di Eagle Vision, l'impossibilità di accedere ai servizi a causa dell'incompatibilità dei dispositivi con i requisiti aggiornati comporterà la perdita del valore economico degli acquisti stessi, senza alcun diritto di rimborso.
Per garantire un'esperienza di utilizzo ottimale, l'utente accetta di scaricare e installare regolarmente eventuali aggiornamenti resi disponibili da Eagle Vision. Tali aggiornamenti sono finalizzati a migliorare la qualità del servizio, ma Eagle Vision non garantisce che essi siano sempre rilevanti per l’utente o che non impattino la sua esperienza di usufrutto dei servizi Eagle Vision. È facoltà del cliente, e prassi attivamente incoraggiata da Eagle Vision, notificare a Eagle Vision eventuali insoddisfazioni legate agli aggiornamenti degli applicativi. Compatibilmente con il numero delle richieste e l’operatività in corso, Eagle Vision si impegna a rispondere ai commenti apportati dai clienti e a tenerli in considerazione per gli aggiornamenti futuri.
Inoltre, tramite aggiornamenti, Eagle Vision si riserva la facoltà di introdurre nuove funzionalità a pagamento. Qualora ciò comporti costi aggiuntivi per l'utente, questi saranno chiaramente e tempestivamente comunicati, garantendo che nessuna spesa venga addebitata senza un'esplicita autorizzazione da parte dell'utente.
Gli applicativi di Eagle Vision raccolgono e conservano i dati personali forniti dagli utenti al fine esclusivo di erogare i servizi richiesti. Per ulteriori dettagli sul trattamento dei dati personali e sui diritti dell'utente in materia di protezione dei dati, si invita a consultare l'Informativa Privacy di Eagle Vision, disponibile sul sito web www.eagle-vision.it.
Alcune funzionalità degli applicativi di Eagle Vision richiedono una connessione Internet attiva, che può essere fornita tramite Wi-Fi o tramite la rete mobile del proprio operatore. Eagle Vision non si assume alcuna responsabilità per il malfunzionamento degli applicativi causato dalla mancanza di connessione o dall'esaurimento del traffico dati disponibile.
Qualora gli applicativi vengano utilizzati al di fuori di un'area coperta da connessione Wi-Fi, l'utente accetta di essere responsabile per i costi derivanti dall'uso della rete mobile, inclusi, ma non limitati a, i costi per il roaming dati. L'utilizzo degli applicativi implica che l'utente abbia ottenuto il permesso del titolare del contratto di telefonia mobile, qualora non fosse egli stesso il titolare del contratto.
L'utente ha la possibilità di chiudere il proprio contratto con Eagle Vision, sottoscritto con l’accettazione dei presenti termini e condizioni, in qualsiasi momento. L’utente dovrà semplicemente cancellare il suo account e confermare la rimozione di tutti i suoi dati, ottenendo così il risultato sperato. Questo interromperà ogni interazione tra Eagle Vision, l’utente e i suoi dati.
Si precisa tuttavia che la chiusura dell'account non dà diritto a rimborso o risarcimento delle somme eventualmente spese in precedenza per l'acquisto di servizi offerti da Eagle Vision. Similmente, la chiusura dell’account non pregiudica la legittimità del trattamento dei dati personali dell'utente avvenuto in precedenza alla decisione di chiusura e cancellazione dati.
In caso di violazione dei presenti Termini e Condizioni, Eagle Vision si riserva il diritto di sospendere o terminare l'account di un utente registrato, impedendo l'accesso ai suoi applicativi. Tale diritto è esercitabile da Eagle Vision indipendentemente dal fatto che l'utente abbia effettuato acquisti sugli applicativi di Eagle Vision che risultino ancora in corso di validità.

Con l’utilizzo degli applicativi di Eagle Vision, e pertanto con l’esplicita o implicita accettazione dei presenti termini e condizioni, l’utente rinuncia a qualsiasi diritto o contestazione nei confronti di Eagle Vision relativamente ai punti sopra elencati.
Tutti i contenuti presenti negli applicativi di Eagle Vision, inclusi, ma non limitati a, video, immagini, testi e loghi, sono di proprietà esclusiva di Eagle Vision o dei suoi licenziatari e sono protetti dalle leggi sul copyright e da altre normative in materia di proprietà intellettuale applicabili.
I servizi di Eagle Vision sono destinati a utenti di età pari o superiore ai 14 anni. Nel caso in cui un minore di 14 anni utilizzi il servizio, è obbligatorio che venga fornita l’autorizzazione preventiva da parte dei genitori o del tutore legale. Per fare ciò, può inviare una comunicazione a legal@eagle-vision.it e la sua richiesta sarà gestita direttamente da un operatore. Se un utente identifica l’utilizzo dei servizi di Eagle Vision da parte di un minore di età inferiore ai 14 anni, è pregato di informare tempestivamente Eagle Vision, affinché possano essere adottate le misure necessarie.
Qualora Eagle Vision scopra che un minore di età inferiore ai 14 anni abbia fornito dati personali, procederà immediatamente alla loro cancellazione dai propri server. Se un genitore o un tutore legale ha motivo di credere che il proprio figlio abbia fornito informazioni personali, è invitato a contattare senza indugi il Servizio Clienti di Eagle Vision all’indirizzo legal@eagle-vision.it, in modo da consentire l’adozione delle azioni correttive necessarie.
Con la presente liberatoria, Eagle Vision si considera svincolata da qualsiasi responsabilità diretta o indiretta relativa a danni all’immagine o alla riservatezza degli utenti che richiedono i suoi servizi. Tale esclusione di responsabilità si applica in tutti i casi in cui i suddetti danni d’immagine non siano riconducibili a violazioni degli obblighi legali a cui Eagle Vision è tenuto.
Nei suoi applicativi, Eagle Vision è integrata con alcuni fornitori esterni in modo da facilitare l’analisi e le funzionalità dei suoi servizi. In particolare, Eagle Vision utilizza Google Analytics e Firebase Analytics per l’analisi anonimizzata delle attività degli utenti; RevenueCat per la gestione dei pagamenti degli acquisti in app; YouTube per l’integrazione di contenuti video; e infine i sistemi di pagamento di Google Play, Apple Store e Stripe per le effettive transazioni tra utente ed Eagle Vision.
Inoltre, alcuni link presenti negli applicativi Eagle Vision possono rimandare a servizi e siti esterni. Per le casistiche eventualmente impattanti gli utenti di Eagle Vision è necessario fare riferimento ai termini e alle condizioni di servizio stabilite da questi siti esterni, così come dai fornitori esterni dei servizi integrati con Eagle Vision. Eagle Vision invita quindi i suoi utenti a consultare tali documenti per una comprensione completa delle condizioni a cui potrebbero essere soggetti.
Nel caso in cui Eagle Vision decida di cessare l’offerta dei suoi applicativi, in tutto o in parte, il diritto dell'utente di utilizzarli cesserà immediatamente in maniera proporzionale. L'utente non avrà diritto a rimborso per i servizi di Eagle Vision che ha già parzialmente utilizzato prima di un’eventuale cessazione del funzionamento degli applicativi. Inoltre, l'utente non potrà richiedere alcun risarcimento per il danno derivante dall'impossibilità di accedere più ai servizi di Eagle Vision.
Qualora Eagle Vision lo ritenesse necessario, in caso di cessazione della fornitura degli applicativi, l'utente sarà tenuto a disinstallare gli applicativi dai propri dispositivi personali.
Per ulteriori informazioni relative ai termini e condizioni dei servizi di Eagle Vision, l'utente è invitato a contattare Eagle Vision all'indirizzo email dedicato legal@eagle-vision.it. La divisione legale di Eagle Vision si impegna a fornire una risposta tempestiva ed esaustiva a ogni richiesta pervenuta.
Qualora, a seguito di un confronto con il dipartimento legale di Eagle Vision, l’utente non ritenga soddisfacenti le spiegazioni e le soluzioni fornite, o continui a non essere soddisfatto dei termini e condizioni che ha firmato, ha il diritto di presentare un reclamo presso le autorità competenti.
Qualsiasi controversia legale derivante dall'interpretazione, applicazione o violazione dei presenti termini e condizioni di servizio sarà sottoposta esclusivamente alla competenza del Tribunale di Milano. La legge applicabile sarà unicamente quella italiana, con esclusione di ogni riferimento a normative o convenzioni internazionali non espressamente richiamate.
I presenti termini e condizioni potrebbero essere soggetti ad aggiornamenti periodici. Eventuali modifiche saranno pubblicate sul sito web ufficiale di Eagle Vision e, ove ritenuto necessario, comunicate direttamente agli interessati.
