This document outlines the Privacy Policy of Eagle Vision S.R.L. (hereby referred to as “Eagle Vision”). The primary language for communication with Eagle Vision is English; however, we also accommodate communications in Italian. For your convenience, an Italian version of Eagle Vision's Privacy Policy is available below, at the end of the English version. You can request an official copy of this Privacy Policy in your own language, and we will provide it to you as soon as possible. Please note that messages or requests in languages other than English or Italian will need to be analyzed and assessed through external parties, which may significantly increase the time required for a response.
Please be aware that, for formal communications between parties, only the Privacy Policies presented below will be considered authoritative. Translations of these Privacy Policies will be deemed valid only if provided by Eagle Vision.
Eagle Vision SRL (hereinafter, “Eagle Vision”), in its capacity as the Data Controller, in compliance with Articles 13 and 14 of Regulation (EU) 2016/679 ("GDPR") and the Code concerning the protection of personal data (Legislative Decree No. 196/2003, as amended by Legislative Decree No. 101/2018), hereby provides the following privacy notice regarding the processing of data collected through its devices.
Eagle Vision is committed to safeguarding the confidentiality of your personal data and ensuring its protection against any event that may expose it to the risk of breach. To this end, Eagle Vision implements policies and practices concerning the collection and use of personal data and the exercise of the rights conferred upon you by applicable laws. Eagle Vision ensures that its policies and practices related to personal data protection are updated whenever necessary, and in any event, in the event of regulatory or organizational changes that may affect the processing of your personal data.
Eagle Vision collects personal and audiovisual data solely for the purpose of providing recordings of sporting performances to individuals who request such services. The data collected, including sports recordings, are processed by Eagle Vision for the delivery of its services and are subsequently shared with the individuals or entities that provided them.
The data collected by Eagle Vision, including sports recordings, are not shared with private third parties or companies for any of the following purposes: informational, investigative, or commercial. Eagle Vision itself, unless explicit consent is obtained from the data subject, does not use the collected data for commercial purposes nor discloses such data through its physical or digital channels.
In the event that Eagle Vision, either directly or through representatives or trusted partners, wishes to use the collected data for purposes other than those specified in this notice, a separate agreement must be entered into with the data owners. Such an agreement will be established based on the specific circumstances at the time and is not documented in the present notice.
For the purposes of this notice, companies that are part of the corporate group to which Eagle Vision belongs are not considered third parties.
The processing of personal data by Eagle Vision is based on the following legal grounds:

For what concerns the video data of areas where sporting activities take place, Eagle Vision collects footage of the monitored area for the entire typical duration of its use for sports-related purposes. By way of example, but not limited to, on a ski slope, Eagle Vision collects video data of the monitored area during the entire period the ski facilities are operational. Given that certain individuals may unintentionally be recorded in public spaces, Eagle Vision’s recording devices are strategically positioned at a distance that ensures no identifiable physical features of individuals are captured.
Furthermore, the recording devices, primarily consisting of cameras and webcams, are intentionally free from optical zoom and remote movement capabilities. Therefore, the acquisition of video data does not infringe upon the privacy rights of individuals, and thus their authorization for filming is not required. To ensure full transparency, representative still frames from the video streams collected by Eagle Vision devices are available at the following web address: www.eagle-vision.it.
For what concerns the identifying data of individuals engaged in activities in sporting areas who request Eagle Vision’s services, these consists of:
These data are provided by the user at the time of registration for Eagle Vision’s services and are inherently necessary to access the offered services. Therefore, by using Eagle Vision’s applications, including mobile applications and the website, users consent to the collection of these data and acceptance of this privacy notice.
For access to Eagle Vision’s services, individuals may need to be identified through an identifying element already linked to their sports activity and recognizable by third parties. By way of example, this could involve identification through an Eagle Vision reader linked to a ski pass used during the sports activity. Eagle Vision collects this indirect identifying data and uses it exclusively for the functional purpose of providing its services. The collected data are not shared with any external party for informational or commercial purposes, and Eagle Vision does not disclose these data externally. Similar to the registration process with Eagle Vision’s applications, self-identification using an Eagle Vision identifier implies acceptance of the collection of these data and the terms of this privacy notice.
The personal data collected and managed by Eagle Vision are processed in compliance with the principles of lawfulness, fairness, and transparency as established by the GDPR. Personal data are processed solely within the company, with the highest level of attention and confidentiality. Audiovisual data are processed automatically by systems that do not allow for either visualization or alteration of their content. Eagle Vision does not have access to the content generated by its systems in formats other than those provided by the users. In the event of errors by Eagle Vision’s automated systems requiring manual intervention, such intervention will be notified to the data owner in question and will be performed exclusively by personnel of Eagle Vision who are expressly authorized to do so.
The personal data provided by users to Eagle Vision and those collected independently by the company are retained solely for the period strictly necessary to provide the requested services. To this end, two distinct data retention policies are applied to the two different types of data mentioned in Article 4, namely (a) video data of areas where sporting activities take place, and (b) identifying data of individuals engaging in activities in these areas who request Eagle Vision's services.
For what concerns the video data of areas where sporting activities take place, these data are retained exclusively for the typical daily duration of the operational period of the relevant sporting area. By way of example, video frames captured by a ski slope camera are stored until the end of the ski day. Subsequently, they are automatically deleted through unalterable digital processes. Should external events prevent these deletion processes from functioning, Eagle Vision’s authorized personnel will promptly restore the IT systems and delete the data as soon as possible, including through manual measures if necessary. During this temporary retention period, video data are stored by Eagle Vision’s systems solely for the following purposes: delivery of requested services, improvement and development of customer services, and short-term availability in the event of the need to restore data or resolve technical issues.
For what concerns the identifying data of individuals engaging in activities in these areas who request Eagle Vision's services, these data are retained for a period of 20 years, unless the user opts for their earlier deletion. As specified in this privacy notice, data owners have the right to request the termination of data collection and storage at any time. However, for technical reasons associated with Eagle Vision's services, discontinuation of the retention of identifying data may prevent users from accessing services and previously provided content.
All data collected by Eagle Vision, regardless of their type, are stored on cloud servers located within the European Union for the entire duration of their retention. These servers are protected by the most advanced cybersecurity measures implemented by the respective storage service providers. These measures are specifically designed to ensure data confidentiality and integrity in compliance with current laws and regulations.
Eagle Vision does not foresee the transfer of collected data outside the European Economic Area (EEA). Should circumstances arise necessitating such a transfer, it will be conducted in full compliance with the GDPR, ensuring the complete protection of the rights of the data subjects.
In accordance with applicable data protection laws, users of Eagle Vision have the right to exercise effective control over their personal data. The rights granted to Eagle Vision users can be categorized as follows:
Right of access to personal data processed
The user has the right to obtain confirmation from the Data Controller regarding whether their personal data are being processed. If such processing is taking place, the user has the right to access the data in question. Moreover, the user may request information about the purposes of the processing, the categories of personal data being processed, the recipients to whom the data have been or will be disclosed, the retention periods, and the source of the data if they have not been provided directly by the user.
Right to rectification, erasure, and restriction of processing of their personal data
The user has the right to rectify, erase and restrict the processing of their personal data in any time. Right to rectification means that the user has the right to request the correction of any inaccuracies in their personal data or the completion of incomplete data. Right to erasure means that the user may request the removal of their personal data from Eagle Vision’s systems unless exceptions apply under the law. Exceptions include circumstances where data must be retained for legal obligations, judicial proceedings, or situations of technical or operational impossibility to perform the erasure. It should be noted that erasure may not always be feasible, such as in cases where data are stored in backup systems to prevent data loss caused by technical failures or are already included in publications, analyses, or reports. In such cases, Eagle Vision will inform the user about the technical or practical impossibility of erasing the requested data. Right to restriction of processing it means that the user may request the limitation of processing of their personal data. This means halting the movement or processing of their data by Eagle Vision and suspending future collection. Users can achieve this by uninstalling Eagle Vision applications from their devices and discontinuing the use of Eagle Vision’s websites and services. However, it is important to note that by halting data collection, the user will no longer be able to access or use Eagle Vision’s services, even if already purchased and still active. Data that have been registered up until the date of the request for interruption of processing will remain unchanged and subject to the processing previously authorized.
Right to data portability to another controller
The user has the right to receive their personal data, which have been provided to Eagle Vision over time, in a structured, commonly used, and machine-readable format. This right also allows the user to request the direct transmission of their data to another third-party controller, who would then assume responsibility as the new data controller. The data portability will be executed without prejudice to the rights and freedoms of third parties while ensuring the security and confidentiality of the data during transmission. However, it should be noted that data transmission by Eagle Vision to a new controller will only be carried out if it is not excessively complex, costly, or operationally burdensome from a technical, organizational, or financial perspective. The right to data portability applies exclusively to personal data that are processed by automated means and are based on the user’s consent or a contractual agreement with Eagle Vision.
Users may exercise their rights regarding personal data at any time by following the formal and easily accessible procedures established. In particular, users may submit their request:

Upon receipt of the request, Eagle Vision will promptly send confirmation of receipt to the sender and will proceed with the request within a maximum of one month from the date of receipt, unless an extension is justified due to the complexity or number of requests.
Once the requested action has been completed, Eagle Vision will inform the user via written communication or telephone, using the contact details currently registered by the user with Eagle Vision as the reference for delivery.
Users may exercise their rights free of charge and without any particular formalities. However, in cases of repeated, excessive, or particularly complex requests, the data controller may request a reasonable financial contribution proportional to the costs incurred in processing the requests.
Eagle Vision implements appropriate technical and organizational measures to ensure the protection of personal data processed, in compliance with current data security regulations. In particular, the following measures are implemented:
In accordance with applicable regulations, Eagle Vision also implements specific procedures for managing potential personal data breaches, which include the obligation to promptly notify such events to the competent authorities and the data subjects involved.
Furthermore, Eagle Vision conducts periodic reviews of the tools used for personal data processing as well as the security measures implemented to ensure their effectiveness and adequacy in light of technological advancements and emerging threats.
As expressly provided by the GDPR, personal data collected by Eagle Vision may be shared with the competent authorities solely in the event of an explicit and formal request based on a legitimate legal basis.
The competent authorities may include, by way of example but not limited to, judicial bodies, regulatory authorities, or public entities, should their request be justified by investigative needs, security concerns, or compliance with specific legal obligations. Eagle Vision ensures that any data transfer is conducted in a controlled manner and limited to the minimum necessary to appropriately respond to the request.
Eagle Vision's services are intended for users aged 14 years or older. In the event that a minor under the age of 14 uses the service, prior authorization must be provided by the minor’s parent or legal guardian. To provide this authorization, the parent or legal guardian can send a communication to legal@eagle-vision.it, and their request will be managed directly by an operator.
If a user identifies that Eagle Vision's services are being used by a minor under the age of 14, they are kindly requested to notify Eagle Vision promptly so that the necessary measures can be taken.
Should Eagle Vision discover that a minor under the age of 14 has provided personal data, it will immediately delete such data from its servers. If a parent or legal guardian has reason to believe that their child has provided personal information, they are invited to contact Eagle Vision's Customer Service without delay at legal@eagle-vision.it to facilitate the adoption of necessary corrective actions.
By means of this waiver, Eagle Vision considers itself released from any direct or indirect liability related to damages to the reputation or privacy of users who request its services. This exclusion of liability applies in all cases where such reputational damages cannot be traced to breaches of the legal obligations to which Eagle Vision is subject.
Within its applications, Eagle Vision integrates certain external service providers to facilitate the analysis and functionality of its services. Specifically, Eagle Vision utilizes Google Analytics and Firebase Analytics for the anonymized analysis of user activity; RevenueCat for managing in-app purchase payments; YouTube for integrating video content; Google Play, Apple Store, and Stripe payment systems for processing actual user transactions with Eagle Vision.
Furthermore, some links present within Eagle Vision applications may redirect users to external services and websites. For the collection and processing of personal data carried out through these links, as well as for the collection and processing of personal data by the aforementioned external providers, users are required to refer to their respective privacy policies. Eagle Vision therefore encourages its users to review these documents to gain a comprehensive understanding of how their personal data is processed.
For further information regarding the processing of personal data or for the exercise of rights provided under applicable laws, interested parties may contact the Data Protection Officer (DPO) at the following address: legal@eagle-vision.it. The Eagle Vision legal department is committed to providing a timely and comprehensive response to every request received.
If, following consultation with the Eagle Vision legal department, a user finds the explanations and solutions provided unsatisfactory, or remains dissatisfied with the manner of processing their data or believes that their rights have not been adequately protected, they have the right to file a complaint with the competent authority. Specifically, for matters of this nature, the relevant authority is the Garante per la Protezione dei Dati Personali (Italian Data Protection Authority), whose official website can be accessed at www.garanteprivacy.it.
Any legal dispute arising from the interpretation, application, or violation of this privacy notice shall be exclusively subject to the jurisdiction of the Tribunale di Milano (Court of Milan). The applicable law will be solely Italian law, to the exclusion of any reference to international laws or conventions not expressly invoked.
This privacy notice may be subject to periodic updates. Any changes will be published on the official Eagle Vision website and, where deemed necessary, directly communicated to the interested parties.

(di seguito, “Eagle Vision”), in qualità di Titolare del Trattamento dei dati personali, in ottemperanza agli articoli 13 e 14 del Regolamento (UE) 2016/679 ("GDPR") e al Codice in materia di protezione dei dati personali (D.lgs. 196/2003, come modificato dal D.lgs. 101/2018), fornisce la seguente informativa privacy riguardante il trattamento dei dati raccolti dai suoi dispositivi.
Eagle Vision tutela la riservatezza dei tuoi dati personali e garantisce ad essi la protezione necessaria da ogni evento che possa metterli a rischio di violazione. Eagle Vision mette in pratica a tal fine policy e prassi aventi riguardo alla raccolta e all’utilizzo dei dati personali e all’esercizio dei diritti che ti sono riconosciuti dalla normativa applicabile. Eagle Vision ha cura di aggiornare le policy e le prassi adottate per la protezione dei dati personali ogni volta che ciò si renda necessario e comunque in caso di modifiche normative e organizzative che possano incidere sui trattamenti dei tuoi dati personali.
Eagle Vision raccoglie dati personali e audiovisivi con la finalità esclusiva di fornire riprese di prestazioni sportive agli individui che lo desiderano. I dati raccolti, riprese sportive incluse, vengono processati da Eagle Vision per l’erogazione dei propri servizi e vengono poi condivisi con i soggetti che li hanno forniti.
I dati raccolti da Eagle Vision, riprese sportive incluse, non vengono condivisi con soggetti privati terzi o aziende per nessuna delle seguenti finalità: informative, conoscitive, o commerciali. Eagle Vision stessa, salvo il consenso esplicito dell’interessato, non utilizza i dati raccolti per finalità commerciali e non li divulga sui propri canali fisici o digitali.
Nel caso Eagle Vision, direttamente o tramite soggetti che la rappresentano o di cui si avvale, volesse utilizzare i dati raccolti durante il suo operato per finalità escluse da questa informativa, allora dovrà concludere un accordo separato con i proprietari di tali dati. Il suddetto accordo sarà stipulato sulla base delle circostanze del momento e non è documentato nella seguente informativa.
Ai fini della presente informativa, non rientrano nella definizione di società terze le società facenti parte del Gruppo societario cui Eagle Vision appartiene.

Per quanto riguarda i dati video delle aree dove si praticano attività sportive, Eagle Vision acquisisce i fotogrammi dell’area inquadrata per tutta la durata tipica di apertura dello spazio destinato alle finalità sportive. A titolo esemplificativo ma non esaustivo, su una pista da sci Eagle Vision acquisisce i dati video dell’area inquadrata per tutta la parte del giorno in cui sono aperti gli impianti da sci. Poiché inquadrando un’area aperta al pubblico alcuni soggetti non interessati ad essere filmati potrebbero essere ripresi, i dispositivi di ripresa di Eagle Vision sono posizionati a una distanza tale da non permettere il riconoscimento dei tratti somatici dei soggetti inquadrati. Inoltre, tali dispositivi di ripresa, costituiti principalmente da telecamere e webcam, sono appositamente privi dello zoom ottico e non consentono il brandeggio da remoto. Ne consegue quindi che l’acquisizione dei fotogrammi dell’area inquadrata non intacca il diritto alla riservatezza dei soggetti inquadrati e pertanto non richiede l’autorizzazione da parte di quei soggetti ad essere filmanti. Al fine di garantire la massima trasparenza, fotogrammi rappresentativi dei flussi video acquisiti dai dispositivi Eagle Vision sono disponibili al seguente indirizzo web: www.eagle-vision.it.
Per quanto riguarda i dati identificativi degli individui che praticano attività nelle aree riprese dai dispositivi di ripresa di Eagle Vision e che richiedono i servizi di Eagle Vision, questi consistono in:
Questi dati vengono forniti dall’utente in fase di registrazione ai servizi di Eagle Vision e sono intrinsecamente necessari per potere utilizzare i servizi offerti. Conseguentemente, procedere all’utilizzo degli applicativi di Eagle Vision, quali applicazione mobile e sito web, implica accettare la raccolta di questi dati e la presente informativa privacy.
Sempre per potere usufruire dei servizi di Eagle Vision, gli interessati potrebbero doversi fare riconoscere tramite un proprio elemento identificativo utilizzato durante l’attività sportiva e che già li rende identificabili da parte di soggetti terzi. A titolo puramente esemplificativo, si potrebbero dovere fare riconoscere tramite un lettore Eagle Vision con un proprio skipass utilizzato durante la giornata di sci. Eagle Vision raccoglie questi dati identificativi indiretti e ne fa un uso esclusivamente funzionale per l’erogazione dei suoi servizi. I dati raccolti in questo modo non sono condivisi con alcun soggetto esterno per finalità conoscitive e commerciali ed Eagle Vision stessa non li divulga esternamente. Similarmente al processo di registrazione sugli applicativi di Eagle Vision, l’auto riconoscimento con un proprio identificativo tramite un identificatore Eagle Vision implica l’accettazione della raccolta di questa tipologia di dati e la presente informativa privacy.
I dati personali raccolti e gestiti da Eagle Vision sono trattati nel rispetto dei principi di liceità, correttezza e trasparenza previsti dal GDPR. I dati personali sono trattati esclusivamente all'interno della società, con il massimo livello di attenzione e riservatezza. I dati audio visivi sono elaborati automaticamente da sistemi che non consentono la visualizzazione né l’alterazione del contenuto. Eagle Vision non ha accesso ai contenuti generati dai suoi sistemi in formati differenti a quelle degli utenti. In caso di errori da parte dei sistemi automatici di Eagle Vision e di necessario intervento manuale, tale intervento sarà notificato al proprietario dei dati in questione e sarà svolto unicamente da personale di Eagle Vision espressamente autorizzato.
I dati personali forniti dagli utenti a Eagle Vision e quelli raccolti autonomamente dalla stessa sono conservati esclusivamente per il periodo strettamente necessario all’erogazione dei servizi richiesti. In virtù di ciò, vengono applicate due diverse politiche di conservazione dati alle due diverse tipologie di dati indicati all’articolo 4, ossia (a) i dati video delle aree dove si praticano attività sportive e (b) i dati identificativi degli individui che praticano attività in tale aree e che richiedono i servizi di Eagle Vision.
Per quanto riguarda i dati video delle aree dove si praticano attività sportive, essi sono conservati solo ed esclusivamente per la durata tipica di apertura giornaliera di quegli spazi. A titolo meramente esemplificativo, i fotogrammi di una pista da sci catturati da una telecamera a bordo pista sono conservati fino al termine della giornata sciistica. Dopodiché, essi vengono autonomamente cancellati tramite processi digitali non alterabili dall’uomo. Qualora, per via di eventi esterni, i suddetti processi non dovessero funzionare, il personale autorizzato di Eagle Vision provvederà a ripristinare immediatamente i propri sistemi informatici e a cancellare al più presto i dati, eventualmente anche con l’utilizzo di misure manuali. Durante il periodo di temporanea conservazione, i dati video sono immagazzinati dai sistemi di Eagle Vision con le seguenti finalità esclusiva: fornitura dei servizi richiesti, miglioramento e sviluppo dei servizi per i clienti, disponibilità a breve termite in caso di necessità di ripristino o risoluzione di eventuali problematiche.
Per quanto riguarda i dati identificativi degli individui che praticano attività nelle aree riprese dai sistemi di Eagle Vision e che richiedono i servizi di Eagle Vision, essi sono conservati per un periodo di 20 anni salvo eliminazione anticipata da parte dell’utente che li possiede. Come espresso nella presente informativa privacy, il proprietario dei dati può sempre esprimere la volontà di interrompere la raccolta e conservazione dei suoi dati. Tuttavia, per ragioni tecniche legate alla tipologia dei servizi di Eagle Vision, l’interruzione della conservazione dei dati identificativi degli utenti impedisce agli utenti che chiedono di interromperla di usufruire dei servizi erogabili da Eagle Vision e di accedere a contenuti erogati in passato.
Indipendentemente dalla loro tipologia, per tutta la durata del periodo di loro conservazione, tutti i dati raccolti da Eagle Vision vengono memorizzati su server cloud situati all’interno del territorio dell’Unione Europea. Tali server sono protetti con le più avanzate misure di sicurezza informatica, implementate appositamente dai fornitori dei servizi di archiviazione stessi. Le suddette misure sono progettate per garantire la riservatezza e l’integrità dei dati in conformità con le normative vigenti.
Indipendentemente dalla natura dei dati raccolti, Eagle Vision non prevede il trasferimento di tali dati al di fuori dello Spazio Economico Europeo. Qualora sopravvenute circostanze rendessero necessario un trasferimento, questo avverrà eseguito nel rispetto totale del GDPR, assicurando la piena tutela dei diritti degli interessati.
In conformità con la normativa applicabile in materia di protezione dei dati personali, gli utenti di Eagle Vision hanno il diritto di esercitare un controllo effettivo sui propri dati personali. A titolo espositivo, i diritti riconosciuti agli utenti di Eagle Vision si possono ricondurre alle seguenti tipologie:
Diritto di accesso ai dati personali trattati
L’utente ha il diritto di ottenere dal Titolare la conferma che sia o meno in corso un trattamento dei propri dati personali e, in tal caso, di accedere a tali dati. Inoltre, può richiedere informazioni sulle finalità del trattamento, sulle categorie di dati trattati, sui destinatari a cui i dati sono stati o saranno comunicati, sui tempi di conservazione previsti, e sull’origine dei dati, qualora non siano stati forniti direttamente dall’utente.
Diritto di rettifica, cancellazione e limitazione del trattamento dei propri dati
L’utente ha il diritto di richiedere la rettifica, cancellazione e limitazione del trattamento dei propri dati personali in qualsiasi momento. Per rettifica dei propri dati personali si intende la correzione di eventuali inesattezze di tali dati o l’integrazione di dati incompleti. Per cancellazione dei propri dati personali si intende la rimozione dei propri dati dai sistemi di Eagle Vision, salvo eccezioni previste dalla legge, come la necessità di conservazione per obblighi legali o per l’esercizio di diritti in sede giudiziaria, o salvo situazioni di impossibilità o estrema difficoltà tecnica od operativa di effettuare tale eliminazione. Si precisa che la cancellazione potrebbe non essere possibile in alcune circostanze, come nel caso di dati salvati su sistemi di backup per prevenire perdite di dati causate da guasti tecnici, o in presenza di dati già inclusi in pubblicazioni, analisi o report. In tali situazioni, Eagle Vision informerà l’utente circa l’impossibilità tecnica o pratica di procedere alla cancellazione richiesta. Per limitazione del trattamento dei propri dati personali si intende l’interruzione della movimentazione e processazione dei propri dati da parte di Eagle Vision, così come la cessazione di ogni futura raccolta. Tale limitazione del trattamento può essere facilmente ottenuta disinstallando gli applicativi di Eagle Vision dai propri dispositivi e smettendo di utilizzare i siti web e i servizi di Eagle Vision. Resta comunque inteso che, interrompendo la raccolta dei dati, l’utente non potrà più accedere o usufruire dei servizi di Eagle Vision, anche se già acquistati e ancora attivi. Inoltre, i dati dell’utente registrati fino al momento della richiesta di interruzione del trattamento rimarranno invariati e soggetti al trattamento precedentemente autorizzato.

L’utente ha il diritto di ricevere i propri dati personali forniti nel corso del tempo a Eagle Vision in un formato strutturato, di uso comune e leggibile da dispositivo automatico. Questo diritto consente, inoltre, di richiedere la trasmissione diretta dei dati dell’utente ad un altro soggetto terzo, che sarà futuro titolare del trattamento dei dati dell’utente stesso. La portabilità dei dati sarà effettuata senza pregiudicare i diritti e le libertà di terzi, garantendo al contempo la sicurezza e la riservatezza dei dati durante la trasmissione. Tuttavia, si precisa che la trasmissione dei dati da Eagle Vision ad un nuovo titolare del trattamento sarà realizzata solo nel caso in cui non risulti eccessivamente complessa o dispendiosa sotto il profilo tecnico, organizzativo o economico per Eagle Vision. Il diritto di portabilità dei dati verso un altro titolare del trattamento si applica esclusivamente ai dati personali trattati con mezzi automatizzati e sulla base del consenso dell’utente o di un contratto stipulato con Eagle Vision.
L’utente può esercitare i propri diritti in relazione ai dati personali in qualsiasi momento, seguendo le procedure formalmente stabilite e di agevole attuazione. In particolare, l’utente potrà inoltrare la propria richiesta:
La richiesta dovrà contenere una descrizione chiara e dettagliata dell’operazione richiesta (rettifica, cancellazione, portabilità verso un altro titolare, ecc.) e specificare i dati personali oggetto della richiesta. Una volta ricevuta la richiesta, Eagle Vision invierà tempestivamente una conferma di ricezione al mittente e darà seguito alla stessa entro il termine massimo di un mese dalla data di ricezione, salvo proroghe motivate dalla complessità o dal numero delle richieste.
Completata l’operazione richiesta, Eagle Vision provvederà a informare l’utente mediante una comunicazione scritta o telefonica, utilizzando come riferimento per la destinazione della comunicazione i recapiti al momento registrati dall’utente su Eagle Vision.
I diritti degli utenti possono essere esercitati senza alcun onere o formalità particolare. Tuttavia, in caso di richieste ripetute, eccessive o di dati particolarmente complessi da modificare, il Titolare potrebbe richiedere un contributo economico proporzionato ai costi necessari per l’elaborazione delle richieste.
Eagle Vision adotta misure tecniche e organizzative adeguate per garantire la protezione dei dati personali trattati, nel rispetto delle normative vigenti in materia di sicurezza dei dati. In particolare, sono implementate misure quali:
In accordo alla vigente normativa, Eagle Vision prevede anche di seguire procedure specifiche per la gestione di eventuali violazioni dei dati personali (data breach), che includono l’obbligo di notificare tempestivamente tali eventi alle autorità competenti e agli interessati.
Inoltre, Eagle Vision effettua verifiche periodiche sugli strumenti utilizzati per il trattamento dei dati personali, nonché sulle misure di sicurezza adottate, al fine di assicurarne l’efficacia e l’adeguatezza rispetto all’evoluzione delle tecnologie e delle minacce.
Come espressamente previsto dal GDPR, i dati personali raccolti da Eagle Vision potranno essere condivisi con le autorità competenti unicamente in caso di esplicita e formale richiesta basata su una legittima base legale.
Le autorità competenti possono includere, a titolo esemplificativo ma non esaustivo, organi giudiziari, autorità di controllo o enti pubblici, qualora la loro richiesta sia motivata da esigenze investigative, di sicurezza o di adempimento a obblighi normativi specifici. Eagle Vision garantisce che ogni trasferimento di dati sia effettuato in modo controllato e limitato al minimo necessario per rispondere in maniera appropriata alla richiesta formulata.
I servizi di Eagle Vision sono destinati a utenti di età pari o superiore ai 14 anni. Nel caso in cui un minore di 14 anni utilizzi il servizio, è obbligatorio che venga fornita l’autorizzazione preventiva da parte dei genitori o del tutore legale. Per fare ciò, può inviare una comunicazione a legal@eagle-vision.it e la sua richiesta sarà gestita direttamente da un operatore. Se un utente identifica l’utilizzo dei servizi di Eagle Vision da parte di un minore di età inferiore ai 14 anni, è pregato di informare tempestivamente Eagle Vision, affinché possano essere adottate le misure necessarie.
Qualora Eagle Vision scopra che un minore di età inferiore ai 14 anni abbia fornito dati personali, procederà immediatamente alla loro cancellazione dai propri server. Se un genitore o un tutore legale ha motivo di credere che il proprio figlio abbia fornito informazioni personali, è invitato a contattare senza indugi il Servizio Clienti di Eagle Vision all’indirizzo legal@eagle-vision.it, in modo da consentire l’adozione delle azioni correttive necessarie.
Con la presente liberatoria, Eagle Vision si considera svincolata da qualsiasi responsabilità diretta o indiretta relativa a danni all’immagine o alla riservatezza degli utenti che richiedono i suoi servizi. Tale esclusione di responsabilità si applica in tutti i casi in cui i suddetti danni d’immagine non siano riconducibili a violazioni degli obblighi legali a cui Eagle Vision è tenuto.
Nei suoi applicativi, Eagle Vision è integrata con alcuni fornitori esterni in modo da facilitare l’analisi e le funzionalità dei suoi servizi. In particolare, Eagle Vision utilizza Google Analytics e Firebase Analytics per l’analisi anonimizzata delle attività degli utenti; RevenueCat per la gestione dei pagamenti degli acquisti in app; YouTube per l’integrazione di contenuti video; e infine i sistemi di pagamento di Google Play, Apple Store e Stripe per le effettive transazioni tra utente ed Eagle Vision.
Inoltre, alcuni link presenti negli applicativi Eagle Vision possono rimandare a servizi e siti esterni. Per la raccolta e il trattamento dei dati personali effettuati tramite questi link, così come per la raccolta e il trattamento dei dati personali tramite i fornitori esterni sopracitati, è necessario fare riferimento alle loro informative privacy. Eagle Vision invita quindi i suoi utenti a consultare tali documenti per una comprensione completa delle modalità di trattamento dei propri dati.

Qualora, a seguito di un confronto con il dipartimento legale di Eagle Vision, l’utente non ritenga soddisfacenti le spiegazioni e le soluzioni fornite, o continui a non essere soddisfatto delle modalità di trattamento dei propri dati o ritenga che i propri diritti non siano stati adeguatamente tutelati, ha il diritto di presentare un reclamo presso le autorità competenti. Qualsiasi controversia legale derivante dall'interpretazione, applicazione o violazione della presente informativa sarà sottoposta esclusivamente alla competenza del Tribunale di Milano. La legge applicabile sarà unicamente quella italiana, con esclusione di ogni riferimento a normative o convenzioni internazionali non espressamente richiamate.
